Limited Warranty

7-Year Warranty Terms below apply to the manufacturer of lift canopies made with 18oz Shelter-Rite® fabric. 

Custom Canopys warrants only to the original purchaser of a Boat Lift Cover (said original purchaser hereafter called the “customer”), that the Custom Canopys Boat Lift Cover, when properly installed and utilized as a boat lift cover, will remain in good visual condition for a period that expires on the last day of the final warranty year. The start date of the warranty is the customer’s actual invoice date. This warranty applies only to failure due to workmanship or material defects subject to the following terms, provisions and conditions: 

In the event of failure and/or defect and written notice of a claim during the applicable warranty period is provided to Custom Canopys,  Custom Canopys provides the following pro-rated warranty schedule: Custom Canopys will pay for a portion of the replacement value and the customer will pay a portion of the replacement value (replacement value is determined by using the prevailing retail price at the time of warranty/replacement) as per the chart below. In the event that Custom Canopys chooses to repair the cover at any time during the warranty period, the customer will not be charged for the repair. Custom Canopys must receive the defective canopy cover within 30 days of the customer claim.

The pro-rated 7-year schedule will be as follows:

Year	Terms
Year 1, 2, 3	Custom Canopys will pay 100% of replacement value. Consumer pays 0%
Year 4	Custom Canopys will pay 60% of replacement value. Consumer pays 40%
Year 5	Custom Canopys will pay 40% of replacement value. Consumer pays 60%
Year 6	Custom Canopys will pay 20% of replacement value. Consumer pays 80%
Year 7	Custom Canopys will pay 15% of replacement value. Consumer pays 85%

 

 

No free repair or prorated replacement will be made for any cover subsequent to the 7 year periods covered by this warranty, or at any time for damage resulting from improper installation of the cover, distortion of the framework upon which the Custom Canopys cover is mounted, negligence, vandalism, acts of God, chemically induced degradation (strong cleaning products), rodent damage or petroleum product damage.  Also this warranty does not cover fading or matching separate cover fabrics.  All claims must be in writing, and all written claims must be submitted prior to the expiration of the applicable warranty period. 

If Custom Canopys is not able to determine if the problem is covered by its warranty through digital inspection means, the customer will be responsible for shipping charges to Rush-Co for a pre-warranty inspection as well as shipping charges back to the customer.  If the problem is covered by Custom Canopys warranty, Custom Canopys will reimburse the customer for the shipping charges. 

THE FOREGOING CONSTITUTES CUSTOM CANOPYS SOLE AND EXCLUSIVE WARRANTY WITH RESPECT TO CUSTOM CANOPYS CANOPIES, AND ALL OTHER REPRESENTATIONS, WARRANTIES, GUARANTEES OR PROMISES.  WHETHER EXPRESSED, WRITTEN, IMPLIED, OR ORAL, ARE HEREBY EXCLUDED.  ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXCLUDED AND DISCLAIMED.  THE LIABILITY OF RUSH-CO HEREUNDER IS LIMITED TO REPAIR OR PRORATED REPLACEMENT AS AFORESAID AND IN NO EVENT SHALL CUSTOM CANOPYS BE LIABLE FOR CONSEQUENTIAL OR SPECIAL DAMAGES OF ANY TYPE WHATSOEVER.
